Arbitration agreement
What does “arbitration agreement” mean?
An arbitration agreement commits the employer and employee to resolve disputes before a private arbitrator instead of in court.
Enforceability turns on how the agreement was presented and what it contains. Terms that are one-sided on cost, remedies, discovery or the selection of the arbitrator are the usual grounds for challenge.
Arbitration also does not dispose of everything. Representative actions in particular interact with arbitration differently from individual claims.
